Do you have a Lemon law in your state ?
I would tell them to return the money and keep the motorcycle

Hey all, thanks so much for the replies and advice.  He was looking at taking legal action, but the lemon law in his state does not apply to motorcycles. Rather than filing a suit, it would have been cheaper and easier to take the cost-sharing option offered by the dealer. However, Guzzi did end up coming through thanks to a lucky fluke. Since I was so frustrated with them initially, in all fairness, I have to give credit where it's due. The mother ship finally got a new transmission shipped over. When it arrived, the dealer went gave it a once-over and surprise, surprise, it had only 70ccs of oil (should be somewhere around 750).  With that lending considerable credence to the notion the original transmission had been under-filled, they put the bike back together and got back in touch with Guzzi, who agreed that the failure was a result of factory defects. So, after a few stressful months, my father finally has the bike back and it's running like it should. The transmission and clutch are much quieter than they initially were, so I'm sure that anyone with Guzzi experience would have noticed immediately that something was off. 

All's well that ends well, hopefully the bugs are ironed out and hopefully no one else gets to experience that fluke. Thanks again for all the responses and concern.

You couldn't make it up could you!!

Should at least be sent with a label attached stating Oil needs to be added before use.

I wonder how close it was to the Dealer simply fitting the 'Box and sending the Bike out again?

 Thanks for the update jonnirado. That's great that you got the right result.
I wonder if anyone at Moto Guzzi will follow it up, to prevent a repeat?
Perhaps someone at Mandello has decimal point dyslexia. I think they've been adding 75cc rather than 750cc.

I still think the supplying dealer has an obligation to check the oil levels before sale.

It must be a relief that it eventually was put right.

My guess is, that's why the Dealer offered the initial 50/50 split of costs.

It would be interesting to read the dealers PDI check list which I would imagine mentions checking all fluid levels, nevertheless a great result all round and hope your father enjoys the bike from now onThumbs Up

My advice to anyone buying any new (or second hand) bike would be to check all fluids for yourself.

Not that I'm a mistrusting old so and so you understand. But I have found it pays off more than once.
